Testimony to begin Tuesday in trial of Dallas man accused of killing elderly family friend

Testimony begins this morning in the capital murder trial of a man who is accused of killing an elderly family friend who tried to help him.

James Mitchell called 72-year-old Mouda Erskine “Granny” but he still robbed and beat her in January 2013, authorities have said.

Erskine’s family members have said that Mitchell was a family friend and that Erskine had been trying to help him after his own grandmother put him out of her house.

“He would go by there and talk to her,” said Erskine’s sister, Marva Miles told The Dallas Morning News after her sister was killed. She said Mouda Erskine often fed Mitchell and sometimes gave him money or let him spend the night in her home.

“You know you trust people, but some people are not trustworthy,” Miles said back then.

Miles and a neighbor discovered Erskine lying face-down on the floor in the hallway of her tiny frame house  near Fair Park about 8 p.m on Thursday, Jan. 31, 2013. Police say 2005 Nissan Altima and jewelry were stolen.

The sister asked a church member to drive her to her sister’s home when she couldn’t reach her. When they got there, a neighbor and the church friend used Miles’ key to get inside. They found Erskine dead on the floor.

A witness told police that he had heard Erskine and Mitchell arguing inside her home about money earlier that week.

A neighbor said Mitchell introduced himself on the day before Erskine died to her own grandson as Erskine’s grandson. She said that after Erskine gave Mitchell a TV, her grandson drove Mitchell to a pawnshop. The neighbor said the pawnshop wouldn’t accept the television because it didn’t work.

About 9 a.m. the day of Erskine’s death, a neighbor heard Mitchell and Erskine arguing inside the home.

Authorities and neighbors say Mitchell was a wanna-be rapper who went by the nickname, “Abso” or “Absolute.”

He previously received a sentence of one year of deferred adjudication probation for a misdemeanor assault charge after he bit a DART police officer in January 2011. The officer said Mitchell tried to board a train without paying a fare and they got into a scuffle.
